This policy does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Online Services.

If you do not agree with our policies and practices, your choice is not to use our Services. By providing information to use or accessing or using our Services, you agree to this privacy policy. CHILDREN UNDER THE AGE OF 13

  • To third parties and data cooperatives for purposes of marketing and to facilitate offers and advertising from others that may interest you. This information may include personal information, order level transaction data, item level transaction data, retail data, mobile application data, and other information relating to purchasing history.

The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties. 

 

INFORMATION DISCLOSED IN CONNECTION WITH BUSINESS TRANSACTIONS

Information that we collect from our users, including personal information, is a business asset.  If the Company is acquired by a third party as a result of a transaction such as a merger, acquisition, or asset sale or if our assets are acquired by a third party in the even that we go out of business or enter bankruptcy, or in the steps in contemplation of such activities (e.g., due diligence), some or all of our assets, including your personal information any other information we collect, receive or use, as described in this privacy policy, will be disclosed or transferred to a third party acquirer in connection with the transaction.  You acknowledge that such disclosures and transfers may occur, and that any acquirer of the Company may continue to use your personal information as set forth in this Privacy Policy.

 

THIRD PARTY PAYMENT SERVICE

We use a third-party payment service to process payments made through the Services, including the Online Services and Offline Services such as in retail locations.  If you wish to make a payment through the Services, your personal information will be collected by such third party and not by us, and will be subject to the third party’s privacy policy and terms of use, rather than this Privacy Policy. 

 

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

 

ACCESSING AND CORRECTING YOUR INFORMATION

Data Retention

We will retain your personal information for no longer than is necessary for the purposes stated in this is privacy policy, unless otherwise extending the retention period is required or permitted by law or subject to our retention policies as may in place from time to time. Right to Opt-Out of Personal Information Sharing

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in by contacting us.

Once we receive your verifiable consumer request, we will delete (and direct our service providers/contractors/other third parties to delete) your personal information from our records unless an exception applies.

Exercising Limitation, opt-out, Rectification, Data Portability, and Deletion Rights

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf may make a verifiable consumer request related to your personal information.

 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. 

 

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

 

Response Timing and Format 

We will try our best to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures will only cover the 12-month period preceding the receipt of the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another and should allow you to further transmit information if you desire.

 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Non-Discrimination

We will not discriminate against you for exercising of your CCPA/CPRA rights. Based solely on the exercise of your CCPA/CPRA rights, we will not:

 

  • Deny you goods or services
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits or imposing penalties
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level of quality of goods or services.

 

However, we may offer you certain financial incentives permitted by the CCPA/CPRA that can result in different prices, rates, or quality levels. Any CCPA/CPRA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

 

DATA SECURITY

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Online Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Online Services like message boards.
